The New Hampshire Supreme Court issued their ruling on the retirement rate increase case this morning.
NEA-NH will meet with our lawyers today to consider the implementations of the ruling and our next steps. This case deals specifically with contribution rate increases.
We hold that there is no indication that in enacting RSA 100-A:16 the legislature unmistakably intended to bind itself from prospectively changing the rate of NHRS member contributions to the retirement system. Because the Federal Constitution affords the plaintiffs no greater protection than does the State Constitution in these circumstances, we reach the same conclusion under the Federal Constitution as we do under the State Constitution. Accordingly, we reverse the trial court’s ruling that the 2011 amendment to RSA 100-A:16, I(a) violated the Contract Clauses of the State and Federal Constitutions. Reversed and remanded.
